In plain language: This policy sets the rules for using Upstrato's website, services, and SaaS products responsibly. In short: don't do anything illegal, don't infringe others' rights, don't upload malware or spam, don't try to break or probe our security, don't reverse-engineer or resell our software without permission, and don't use our AI or social-media tools to create harmful, deceptive, or unlawful content or to violate platforms like Meta or Google. Break these rules and we may suspend or terminate your access and, where required, report it to the authorities. This summary is for convenience only — the full policy below controls.
1. Introduction
This Acceptable Use Policy (the "Policy") describes activities that are prohibited when using the website, services, and products of Upstrato ("Upstrato," "we," "us," or "our"), a brand of Upstrato Technologies Pvt. Ltd., registered in India. Upstrato is an AI-native software studio providing AI solutions, custom software development, website and mobile app development, SaaS product development, social-media software tools, AI SaaS products, Agentic AI, and AI agents.
This Policy is incorporated into and forms part of our Terms of Service. By accessing or using any of our offerings, you agree to comply with this Policy. Capitalized terms not defined here have the meanings given in the Terms of Service.
2. Scope
This Policy applies to everyone who interacts with Upstrato, including:
- Website visitors who browse or use https://upstrato.co.in;
- Clients who engage us for custom software, AI, web, mobile, SaaS, or social-media tool development; and
- SaaS Users who access or use our SaaS Products, including AI SaaS products, whether as a paying subscriber, an authorized user under a Client account, or an end user.
You are responsible for ensuring that anyone using our Services through you or under your account complies with this Policy.
3. Prohibited Activities
You must not use the Website, Services, or SaaS Products to engage in, facilitate, or encourage any of the following:
3.1 Illegal & Unlawful Use
- Any activity that violates applicable local, national, or international law or regulation, or that promotes or facilitates illegal activity.
3.2 Infringement of Intellectual Property
- Uploading, distributing, or using content that infringes or misappropriates any patent, copyright, trademark, trade secret, or other intellectual property or proprietary right of any person.
3.3 Malware & Harmful Code
- Uploading, transmitting, or introducing viruses, worms, trojans, ransomware, or any other malicious or harmful code, files, or programs.
3.4 Spam & Unsolicited Messaging
- Sending spam, bulk unsolicited messages, chain messages, or other unsolicited commercial or promotional communications, or violating anti-spam or electronic-communication laws.
3.5 Scraping & Rate-Limit Abuse
- Scraping, crawling, harvesting, or systematically extracting data from the Website or SaaS Products without authorization; or abusing, circumventing, or overloading rate limits, quotas, or usage restrictions.
3.6 Security Breaches & Probing
- Attempting to gain unauthorized access to, breach, probe, scan, or test the vulnerability of any system, network, or account; defeating or circumventing authentication or security measures; or interfering with the proper functioning of any system.
3.7 Reverse Engineering
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, underlying models, or structure of our software, SaaS Products, or AI systems, except to the limited extent expressly permitted by applicable law or by us in writing.
3.8 Unauthorized Resale
- Reselling, sublicensing, renting, leasing, or otherwise commercially exploiting or making the Services or SaaS Products available to third parties without our prior written authorization.
3.9 Misuse of AI Features
- Using our AI solutions, AI agents, Agentic AI, or AI SaaS features to generate, distribute, or facilitate content that is unlawful, harmful, deceptive, fraudulent, defamatory, or infringing; to create malware or facilitate attacks; to produce non-consensual, exploitative, or abusive material; to generate disinformation, deepfakes, or deceptive impersonations; or to circumvent the safety, usage, or content policies of any underlying AI model or provider.
3.10 Impersonation & Deception
- Impersonating any person or entity, misrepresenting your affiliation, or falsifying identity or origin of communications.
3.11 Harassment & Hate
- Harassing, threatening, bullying, stalking, or intimidating any person; or creating or distributing content that promotes hatred, discrimination, or violence against individuals or groups based on protected characteristics.
3.12 Violating Third-Party Platform Policies
- When using our social-media software tools or integrations, violating the terms, policies, or automation and platform rules of any third-party platform (including, for example, Meta/Facebook/Instagram, Google/YouTube, X, LinkedIn, or TikTok), including their developer, advertising, spam, and automation policies.
This list is illustrative and not exhaustive. We may treat any conduct that we reasonably consider abusive, harmful, or contrary to the spirit of this Policy as a violation.
4. Fair Use of AI & Compute Resources
Our AI features and SaaS Products rely on shared compute, storage, model, and network resources. To ensure availability and fairness for all users, you agree to:
- use AI, compute, API, and storage resources only within the limits, quotas, and fair-use thresholds of your plan or Service Agreement;
- avoid automated, high-volume, or excessive usage patterns that place an undue burden on infrastructure or degrade performance for others;
- not use the Services for cryptocurrency mining, large-scale unauthorized training on our outputs, or other resource-intensive activities outside the intended purpose of the Services; and
- not attempt to circumvent usage metering, throttling, or billing controls.
We may monitor usage and apply reasonable technical controls, throttling, or additional charges to protect the integrity and availability of the Services.
5. Consequences of Violation
If we determine, in our reasonable discretion, that you have violated this Policy, we may take any action we deem appropriate, including:
- issuing a warning and requiring you to cease the violating activity;
- restricting, throttling, suspending, or terminating your access to the Website, Services, or SaaS Products, in whole or in part;
- removing or disabling access to offending content;
- terminating an engagement or account without refund where permitted by our Refund Policy and the Terms of Service; and
- reporting the activity to, and cooperating with, law enforcement, regulators, affected platforms, or other authorities where required or appropriate.
We may act without prior notice where necessary to protect the security, integrity, or availability of the Services, our users, or third parties, or to comply with legal obligations. Any suspension or termination does not relieve you of your payment obligations for Services already provided.
6. Reporting Abuse
If you become aware of any activity that violates this Policy, or of security vulnerabilities, abuse, or misuse of our Services, please report it to us at support@upstrato.co.in (or legal@upstrato.co.in for legal or intellectual-property concerns). Please include enough detail for us to investigate, such as the nature of the issue, relevant URLs or account details, and any supporting evidence. We take reports seriously and will investigate as appropriate.
7. Changes to This Policy
We may update this Policy from time to time to reflect changes in our Services, technology, or legal requirements. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Policy.
